Terms and Conditions of Use
Irishtarot is a registered business name (RBN) in Ireland - registered number 284085, the registered address is House 66, Pier 19, Ushers Island. Dublin 8. Irishtarot provides Tarot and Tarot related services via the internet and over the telephone for clients worldwide.
In order to use any part of Irishtarot.com or it's services you must agree to these terms and conditions.
Agreement
1.0 Effect of this agreement
1.1. By agreeing to these terms and conditions, you are bound by the entirety of this agreement and by our 'Privacy Policy' which is incorporated by reference into these terms and conditions. If there is any inconsistency between these terms and conditions and any document incorporated by reference, these terms and conditions will prevail.
1.2. If we change these terms and conditions we will take appropriate steps to bring such changes to your attention (such as by placing a notice of such change on a prominent position on the Website, together with the changed terms and conditions). Your continued use of the website after such amendment and notification will be deemed to be your acceptance of the changes to the terms and conditions. Any services you have booked prior to the time of amendment and notification of the changed terms and conditions will be subject to the pre-existing terms and conditions.
2.0 Your representations
2.1. You are over 18.
2.2. You are acting as a principal and not as an agent on behalf of a third party.
2.3. If paying by credit or debit card for a service on Irish Tarot, you are the authorised user of such card. At no time in the past have you failed to honour a payment for any Tarot, Tarot related, Psychic, Psychic related or mystical advice service in the past by charging back to your card issuer a payment made by card for Tarot related services.
2.4. You undertake to use our services for legitimate purposes only. In particular you undertake not to engage in any activity whose sole or primary purpose is to cause damage to or in any way hinder our business operations or generate or increase a liability on us to any third party.
2.5. You undertake to use our services for entertainment purposes only and understand and accept entirely that Irishtarot shall never be held responsible for any action taken by you or anybody as a result of information provided by Irishtarot in a Tarot reading or otherwise.
2.6. You accept that Irishtarot's services are offered as entertainment only and all data contained in Tarot readings shall at all times be regarded as a work of fiction. Irishtarot offers no guarantee to the level of accuracy of this information and it is provided as is. The products we offer are Tarot Readings for entertainment reasons, you accept that no form of compensation or refund will be offered in the event of you feeling unhappy with the content of your reading.
3.0 Privacy
3.1 Any information you send us will be processed in accordance with our Privacy Policy (accessible on the Website or on request).
4.0 Accounts and Payments
4.1.1. There is no charge to open an account with Irishtarot.
4.1.2. You are only allowed hold one single account with Irishtarot.
4.1.3. Irishtarot may suspend or delete accounts at its discretion without notice to you or any third party. If you have any saved readings or saved data of any type on the Irish Tarot Website this will also be deleted at the discretion of the company.
4.1.4. Irishtarot may at any time delete readings saved by you or us on your account without notice even if the saved reading was a paid reading.
4.1.5. You agree to provide accurate registration information. You agree to inform us of any changes in such details.
4.1.6. You authorise our bank currently "Ulsterbank" and/or payment gateway "Realex" with or without "Streamline" to use any means that they consider necessary to verify your identity and creditworthiness with any third party providers of information.
4.1.7. Registration will be conducted under our secure server where your credit card data and user details will be encrypted. "Thawte" provides Irish Tarot with a Secure Certificate to verify the encryption.
4.2. If you register with us via the Website, upon completion of registration, we will confirm by electronic mail to the address you have supplied that your account is open. If you register with us via the Telephone we will only confirm registration by post if you do not have an electronic mail address.
4.2.1. You agree to keep your username, password confidential and that you are responsible for any misuse of your password. Provided that we have been correctly supplied with the account information requested, we are entitled to assume that orders and payments are made by you.
4.2.2. You agree to inform us at once by electronic mail or telephone if you believe that your account information is being misused by a third party so that we may suspend your account.
4.2.3. If you are using the Website, we recommend that you disable any automatic password memory in your browser prior to use, and that you log out of your account when you leave your computer. This will help to limit the risk of unauthorised use of your account. Irishtarot will allow you to be connected for as long as you use your computer, therefore it is important that you sign out before leaving your computer if the computer is shared. Section 4.2.1 will apply if a third party uses your account after your password was saved and automatically entered by your browser or if your account was left signed in.
4.2.4. Refunds will be given only at the managements discretion and we will investigate all possibility of fruad in the event of a refund request being presented to us. If we suspect fruad we will notify the Gardai (Police) and the bank. In this special case we will pass on all of your account details and readings to the bank and the Gardai so that they may investigate the fruad in more detail, additionally by agreeing to these terms and conditions you understand and agree to allow us to make fruad checks with any third party against your details. The Gardai and Bank will have complete access to our investigation. We will pursue any findings of fruad to the maximum extent of the law.
5.0 Use of Irishtarot's services
5.1. Irishtarot provides both free and paid Tarot Reading and Tarot Reading related services.
5.2. Free services carry no guarantee that they will operate and are provided as is.
5.3.1 Paid Tarot services, unless clearly specified carry a maximum of 1 question per paid reading. If you wish to present more questions to our paid reading service you will need to treat them as Individual Tarot Readings paying the full price for each reading.
5.3.2 It is your responsibility to ensure that you only enter only one question per reading. If a reading is sent with more than one question then this will be seen as a breach of section 5.3.1. in which case the reading will be rejected without refund.
5.3.3. Irishtarot will attempt to complete your paid reading as quick as possible and no paid reading should take longer than 28 days to be completed by our reading team. If we do take longer than 28 days to complete your reading then a full refund will be given. In the case where a fee was paid to have the reading completed in a set time, we will do our best to complete it in that time, however this is only a guideline as all readings can take up to 28 days regardless of any fee or priority selected.
5.3.4. Tarot reading content and Tarot Reading URLs may be sent to third parties such as friends or family by yourself for example purposes only.
5.3.5. Tarot readings may be printed for personal use.
5.3.6. Tarot readings may be deleted by yourself or at any time by Irish Tarot as described in section 4.1.4.
5.3.7. Once a Tarot Reading has been completed the service will be considered delivered. No more communication will exist between Irish Tarot and you as regards that completed reading. If you wish to ask more questions about a topic raised in your reading you will need to pay for a new reading.
5.3.8. Your reading will be carried out by a Tarot Reader on our reading team, we will do our best to make sure the same reader reads for you each time where possible, however we may change the reader assigned to you at any given time without notice.
5.4.1. You must not record Telephone Tarot Calls. It is an offence to record a telephone call without making it clear that you are doing so to all parties involved in that call.
5.4.2. Irish Tarot Premium Rate Telephone reading services in Ireland are charged at two euro forty per minute. Irish Tarot also provide "pay per block" readings where a fee is agreed before the call for a set amount of time. The fees for this service will vary from customer to customer and we may change the price of this service at any time.
5.4.3. Mobile phone SMS text message Tarot Readings are charged at two euro per message received on the 57033 shortcode, in the United Kingdom texts are charged at one pound fifty sterling per message received on the 85122 shortcode. To exit such services text the keyword STOP at any time. We agree to completely comply with RegTel as the managing body for premium rate service in Ireland.
6.0 Intellectual property.
6.1 Irishtarot and the Irishtarot logo are registered trademarks of Irishtarot and Irishtarot is the sole owner of Irishtarot and the Irishtarot logo. Any unauthorised use of Irishtarot and the Irishtarot logo may result in prosecution.
6.2 www.irishtarot.com is the uniform resource locator ('URL') of this business and no unauthorised use may be made of this URL on another website or digital platform without our prior written consent.
6.3 David A. O'Reilly is the sole owner of the rights to our technology, software, business systems, Tarot Card images, trademarks and business name Irishtarot.
6.4 Your registration and use of Irishtarot confers no rights whatsoever to the intellectual property contained on Irishtarot.com. You agree not to use any automatic or manual device to monitor or copy our web pages or any content therein. Any unauthorised use or reproduction may be prosecuted.
7.0 No Endorsement
7.1 Irishtarot does not represent or endorse the accuracy or reliability of any content posted on any Interactive Area and you acknowledge that any reliance upon such content shall be at your sole risk. Any content placed on any Interactive Area by users are the views of the user posting the statement, and do not represent the views of Irishtarot.
7.2 The website provides links to sites on the Internet, which are owned and operated by third parties. You acknowledge that Irishtarot is not responsible for the availability of, or the content located on or through any External Site. You should contact the site administrator or Webmaster for those External Sites if you have any concerns regarding such links or the content located on such External Sites not Irishtarot.
8.0 Assignment
8.1 You may not assign any part of this agreement.
9.0 Severability.
9.1. In the event that any provision of these terms and conditions is deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in line with the intention of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.
10.0 Breach of this agreement
10.1. Without limiting our other remedies, we may suspend or terminate your account and refuse to continue to provide you with our services, in either case without giving you prior notice, if you breach any term of this agreement or we believe that your actions may result in legal liability for you, for Irishtarot or for third parties.
11.0 Dispute resolution
11.1. In the event of a dispute arising between us and you, our customer service staff will attempt to reach an agreed resolution.
11.2. Should our customer service staff not be able to reach an agreement with you, our senior management may intervene to resolve any outstanding grievance.
12.0 Governing law and jurisdiction
12.1. This agreement is governed by the laws of Eire / Republic of Ireland.
12.2. The courts of Eire / Republic of Ireland have non-exclusive jurisdiction.
