Co. Limerick. Ireland (“Company”) AND ALL VISITORS AND CUSTOMERS.

IT IS AGREED AS FOLLOWS:


1. DEFINITIONS & INTERPRETATION

"Company" means Irish Tarot registered in the Republic of Ireland / Éire with company number 503940 whose registered office is at Woulfe Accounts, Thomas St. Rathkeale. Co. Limerick. Ireland.

"Website" refers to the IrishTarot.com website and all its variations, protocols, technology, content, images, services, database and all data.

"Tarot reading" means a reading provided to a customer by the Company or a contractor or subcontractor of the Company.

"Telephone reading" means a Tarot reading service provided by telephone to a customer.

"Phone reading" means a Tarot reading service provided by telephone to a customer.

"Email reading" means a Tarot reading service provided in writing either by email, made available online or any kind of online transmission to the customer.

"Online reading" means a Tarot reading service provided in writing either by email, made available online or any kind of online transmission to the customer.

"Privacy Policy" means our published privacy policy available at http://www.irishtarot.com/privacypolicy.html

2. USE OF WEBSITE

2.1 You will be able to access the majority of this Website without having to register any details with us. However, particular areas of this Website will only be accessible only if you have registered.

2.2 You are permitted to use our website for your own purposes and to print and download material from this Website provided that you do not modify any content without our consent. Material on this website must not be republished online or offline without our permission.

2.3 The copyright and other intellectual property rights in all material on this Website are owned by the Company and must not be reproduced without our prior written consent.

2.4 Subject to paragraph 1.3, no part of this Website may be reproduced without our prior written permission.

3. SITE UPTIME

3.1 We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and other technical issues. Therefore we will not be liable if this website is unavailable at any time.

3.2 This Website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.

4.1 With the exception of personally identifiable information, the use of which is covered under our Privacy Policy, any material you send or post to this Website shall be considered non-proprietary and not confidential. Unless you advise to the contrary we will be free to copy, disclose, distribute, incorporate and otherwise use such material for any and all purposes.

4.3 We will fully co-operate with the law enforcement authorities of the Republic of Ireland or an Irish court order requiring us to disclose the identity or other details of any person posting material to this website in breach of section 4.

We have not reviewed each third party website and have no responsibility for such third party websites or their content. We do not endorse the third party websites or make representations about them or any material contained in them.   • (d) your website does not contain content that is offensive, controversial, infringes any intellectual property rights or other rights of any other person or does not comply in any way with the law in the Republic of Ireland.

5.3 If you choose to link to our website in breach of Paragraph 5.2 you shall fully indemnify us for any loss or damage suffered as a result of your actions.

6. Accounts and Payments

6.1 There is no charge to open an account with the Website.

6.2 Customers are permitted to hold a single account with the Website. Any customer found to hold or have opened more than one account, either with a different email address or phone number will be considered abusing the Website and the Company reserves the right to refuse services to the customer and delete their accounts without notice. Any credit remaining will be retained by the Company.

6.3 The Company reserves the right to suspend or delete accounts at its discretion without notice or reason.

6.4 The Company may at any time delete readings, recordings or any other record saved by you or us on your account without notice.

6.5 You agree to provide accurate registration information. You agree to inform us of any changes in such details to keep your account up to date.

6.6 You authorise our bank currently "Ulsterbank" and/or payment gateway "Realex" with or without "Streamline" to use any means that they consider necessary to verify your identity and creditworthiness with any third party providers of information.

6.7 Registration will be conducted under our secure server where your credit card data and user details will be encrypted. "Thawte" provides the Company with a Security Certificate to verify the encryption, customers are advised to check the certificate to ensure it is valid.

6.8 You agree to keep your username, password confidential and that you are responsible for any misuse of your password. Provided that we have been correctly supplied with the account information requested, we are entitled to assume that orders and payments are made by you.

6.9 You agree to inform us at once by electronic mail or telephone if you believe that your account username and or password has been compromised.

6.10 If you are using the Website, we recommend that you disable any automatic password memory in your browser prior to use, and that you log out of your account when you leave your computer.

6.11 Refunds will be given only at the managements discretion and we will investigate all possibility of fruad in the event of a refund request or chargeback being presented to us. If we suspect fruad we will notify the police and the bank.

6.12 You the customer agree to allow the Company to conduct and make fruad checks with any third party against your details if we feel there is a risk of fraud by offering you services.

6.13 If a dispute is raised for whatever reason we will pass on all of your account details, call recordings to the bank, the police, our or your solicitor, the courts or any other interested third party so as to investigate the dispute.

7. DISCLAIMER

7.1 We take all reasonable steps to ensure that the information on this Website is correct. However, we do not guarantee the correctness or completeness of material on this Website. We may make changes to the material on this Website at any time and without notice. The material on this Website may be out of date, or on rare occasions incorrect and we make no commitment to ensure that such material is correct or up to date.

8.2 Tarot Readings are provided for entertainment purposes only and come with absolutely no guarantee to accuracy or relevance to any person, place or individual. Any resemblance of the content of a Tarot reading to any real person living or dead, situation, problem or question is purely coincidental. Neither the Company nor any other party (whether or not involved in producing, maintaining or delivering the Tarot reading), shall be liable or responsible for any kind of loss or damage that may result to you or a third party as a result of any Tarot Reading provided by them or us. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this Website.

8.3 Nothing in these Terms shall exclude or limit liability for (i) death or personal injury caused by negligence; (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the Republic of Ireland.

9. GOVERNING JURISDICTION

9.1 This Legal Notice shall be governed by and construed in accordance with Irish law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of the Republic of Ireland.
